AEQUITAS SEQUITUR LEGEM



    The word AEQUITAS SEQUITUR LEGEM is a Legal Maxim which means equity follows the law. The concept clearly explains that law of equity does not aid  a person one who is at fault. One should not seek the help of court for equity with dirty  hand.

Case: Anil Kumar Verma vs. State of UP & Ors (2008)

    The Petitioner's name was not included in the list of the selected candidate although he had been awarded 530 marks, less 1 mark from other candidates although two vacancies were available in the select list to accommodate the Petitioner as the other selected candidate did not join the services.

    The High Court of Allahabad held -  "the Petitioner's case is only based on the equity. as because he is only short of one mark and not placed in the select list of the year 2000 against the vacancy created for the Scheduled Caste candidates, he can be easily accommodated even in 2006 as no period is fixed under the Rules for lapsing the select list. according to us, equity is not one way traffic. Equity follows law following the maxim Aequitas Sequitur Legem. In other words, it is moving on the periphery of law and when law allows to enter, forms a Zygote"
